1. Definition of Terms

  • "Exhibitor" means any company, organization or group that has submitted a participation application and paid a down payment to participate in the Exhibition.
  • "Exhibition" means 'Korea Eco-Friendly Competition'.
  • "Organizer" means "Korea Environmental Industry & Technology Institute".
  • "Agency" means an agent later selected by a technology institute.

2. Application

  • The Organizer will assign a booth location to the Exhibitor based on the payment of the participation fee, the payment order of down payment, the size of the exhibit, the characteristics of the exhibit, and other reasonable methods.
  • In the event of unavoidable circumstances, the Organizer may change the location or size of the space allocated to the Exhibitor prior to installation, and the Exhibitor shall not be entitled to object or to claim compensation.

3. Exhibition Booth Assignment

  • The organizers shall allocate the space in accordance with the order of application, size of the space applied for, the nature of the exhibits or in the manner the organizer deem fit.
  • The organizers shall reserve the right to change the location and/or the size of the space allocated to the exhibitor at any time prior to the commencement of the build-up of the exhibition, should exceptional circumstances demand, and the exhibitor shall have no claim for compensation as a result of changes.

4. Use of Exhibition Space

  • The Exhibitor shall exhibit the Items specified in the application form during the Exhibition period and shall arrange the support staff to ensure the management of the booth.
  • If the Exhibitor exhibits Items that are different from those specified in the application form or Items that do not conform to the nature of the Exhibition, the Organizer may order immediate suspension, removal or dismissal. In such a case, the participation fee will not be refunded and the Exhibitor cannot make any claim for compensation.
  • Exhibitors are not allowed to remove Exhibition Items before the Exhibition is over.
  • The Exhibitor shall not transfer all or part of its allocated Exhibition space to the any other person, company, etc. without the written consent of the Organizer.
  • The Exhibitor shall operate and manage the exhibited Items so as to not cause damage to other Exhibitors or visitors. In the event that damage does occur, the Organizer may order the Exhibitor to cease.
  • The Organizer may order the removal of Items that infringe any intellectual property rights.

5. On-site Sales Behavior

  • The Exhibitor may sell the Items in the booth.
  • However, Exhibitors who want to sell products on-site must first obtain approval from the Organizer.

6. Terms of Payment

  • The application fee must be paid to the Agency at the time of application, and the balance and incidental expenses must be paid by July 13, 2018.
  • If the Exhibitor fails to pay the participation fee within the specified period, the Organizer (Agency) may cancel the participation agreement, and in this case, the Exhibitor cannot claim a refund for the participation fee already paid.
  • If the Exhibitor fails to pay the participation fee, the Organizer (Agency) may seize the Exhibition Items of the Exhibitor.

7. Cancellation or Changes of Exhibition

  • If the Agency (Organizer) cancels the Exhibition, the Organizer shall refund the full amount already paid by the Exhibitor to the Exhibitor. However, in the case of force majeure such as natural disasters, or other reasons not attributable to the sponsor, a refund will not be given in such case as the Exhibition is canceled or changed or shortened. In such a case, the Exhibitor cannot claim compensation from the Organizer (or the Agency).

8. Partial Use Cancellation and Penalties

  • If the Exhibitor partially cancels the use of its Exhibition booth, the following penalty amount shall be paid to the Organizer (Agency) within 15 days after cancellation of use. However, participation fees paid shall be deducted by the same penalty, and additional payment will be made if there is a shortage, and a refund will be made if there is a surplus.
    ▶ If the Exhibitor cancels within one month from the day before the Exhibition commencement date
    : Cancelled Area / Application Area × Participation Fee (including assembly-type booth) × 80%
    ▶ If the Exhibitor cancels before 1 month in advance of the Exhibition date
    : Cancellation Area / Application Area × Participation Fee (including assembly-type booth) × 50%

9. Cancellation and Cancellation Fees

  • If the Exhibitor cancels its participation after submitting the application form, the Exhibitor must pay the Organizer(Agency) the following cancellation fees within 15 days after the cancellation. However, participation fees paid shall be deducted by the same penalty, and additional payment will be made if there is a shortage, and a refund will be made if there is a surplus.
    ▶ If the Exhibitor cancels within one month from the day before the Exhibition commencement date
    : Participation Fee (including assembly-type booth) x 80%
    ▶ If the Exhibitor cancels before 1 month in advance of the Exhibition date
    : Participation Fee (including assembly-type booth) × 50%

10. Equipment and Display of Items

  • The Exhibitor shall bring equipment and Exhibition Items to the allocated Exhibition area and shall complete setup of display within the designated period.
  • Exhibitors are not allowed to alter the floor, ceiling, pillars, or area of the Exhibition space. Any damages caused to the Organizer such as having to pay to restore the Exhibition Hall to its original state due to an Exhibitor's actions shall be recompensed to the Organizer by the perpetrating Exhibitor.

11. Removal of Exhibition Items and Equipment

  • The Exhibitor shall dismantle all Exhibition Items and equipment and remove these from the Exhibition Hall within the designated period. If an Exhibitor delays such removal, the Exhibitor shall bear the costs incurred.

12. Exhibition Hall Costs, Burden of Risk and Insurance

  • The Organizer (Agency) may impose restrictions on equipment and Exhibition Items that threaten safety.
  • The Organizer (Agency) shall take appropriate security measures for Exhibitors and visitors. However, the Exhibitor shall be entirely responsible for any damage and theft of equipment and Exhibition Items within the space of the allocated area during the Exhibition period and equipment assembly and disassembly periods.
  • An Exhibitor shall be liable for the entirety of compensation in such case as such Exhibitor causes fire, theft, breakage or other damage caused to the Organizer (Agency) or others affected in such case as such Exhibitor is responsible for such damage whether caused deliberately or accidentally.

13. Fire Rules

  • Equipment and all materials within the Exhibition Hall shall be properly fire-retarded in accordance with the fire regulations.
  • The Organizer (Agency) may require an Exhibitor to make corrections to be compliant with fire regulations where necessary.

14. Supplementary Regulations

  • If necessary, the Organizer may make supplementary regulations that are not specified in the Exhibition Participation Regulations for smooth operation of the Exhibition.
  • Supplementary provisions shall be part of the Participation Rules and Exhibitors shall comply with them.
  • Exhibitors must comply with the COEX Regulations.

15. Exhibitors Privacy Policy

  • This Exhibition protects the personal information and rights of Exhibitors according to the Personal Information Protection Act and there shall be in place a Personal Information Processing (Privacy) Policy related to the handling of personal information and the personal information of Exhibitors shall be handled in accordance with said Personal Information Processing (Privacy) Policy.

16. Resolution of Disputes

  • Disputes arising between the Organizer and an Exhibitor regarding the participation rules and the rights and obligations of both parties shall be settled in accordance with the Commercial Arbitration Rules of the Korean Commercial Arbitration Board.
    The arbitration of the Korean Commercial Arbitration Board shall be final and binding on both parties.
